Kratom Laws in Texas (2026): Age, Product Limits and Rules
Updated Oct 21, 2026
Status (Oct 2026): Legal for adults.
Texas regulates kratom under the Texas Kratom Consumer Health and Safety Protection Act (Tex. Health & Safety Code ch. 445), effective Sept 1, 2023. Kratom is not a controlled substance in Texas.
Key rules
- Products may not be adulterated or contaminated, and may not contain more than 2% 7-OH in the alkaloid fraction or synthetic alkaloids.
- Labels must include use directions and a recommended serving size.
- Selling to anyone under 18 is a Class C misdemeanor. KratomTrail and most merchants require 21+.
- Civil penalties are $250, $500, then $1,000 per violation.
On KratomTrail
Concentrated 7-OH products are restricted, so KratomTrail hides them for Texas.
Federal note
The DEA published a notice of intent on Oct 14, 2026 to temporarily schedule 7-OH. A final order can issue on or after Nov 13, 2026 and would apply in every state. See 7-OH legal status.
Local rules
Cities and counties can be stricter than state law. Check your local ordinances, and see shipping restrictions.
